These Terms of Service (the “Terms”) govern your access to and use of the services, website(s), online booking portals, communications, and in‑clinic treatments and products provided by Beauty by Us Miami ("Beauty by Us Miami,” “we,” “us,” or “our”). By booking an appointment, purchasing a service or product, visiting our clinic, or using our website, you agree to these Terms. If you do not agree, please do not use our services.
Important: Aesthetic and wellness treatments involve risks and are not a substitute for medical care. You will be asked to complete medical intake forms and consent documents before any treatment. Results vary by individual and are not guaranteed.
1) Eligibility & Client Responsibilities

Age: Clients must be at least 18 years old for injectable or laser services. Clients 16–17 may be eligible for certain services with in‑person parental or legal guardian consent. We do not treat clients under 16.

Accurate Information: You agree to provide complete, accurate, and current information on all health history, medications, allergies, and prior procedures, and to update us if anything changes.

Compliance: You agree to follow pre‑ and post‑care instructions, disclose recent procedures, sun exposure, or illnesses, and to notify us of adverse effects immediately.
2) Consultation, Treatment & Consent

Consultation Required: Some services require an in‑person or virtual consultation to assess suitability and design a treatment plan.

No Guarantee of Service: We reserve the right to decline or postpone treatment if, in our professional judgment, it is unsafe or contraindicated.

Informed Consent: You must review and sign procedure‑specific consent forms each visit. Consents explain benefits, risks, alternatives, potential side effects, and expected outcomes.

Photography: With your consent, standardized photos/video may be taken for charting, treatment planning, and outcomes tracking. Separate consent will be obtained for any marketing use.
3) Medical & Wellness Disclaimer

We provide non‑surgical aesthetic and wellness services. We are not an emergency or primary medical care provider.

Treatments may have contraindications and risks including but not limited to bruising, swelling, burns, pigment changes, scarring, infection, allergic reactions, vascular compromise, and unsatisfactory results.

Individual Results Vary: Outcomes depend on your physiology, adherence to care instructions, and lifestyle factors. Multiple sessions may be required.
4) Appointments, Deposits, Cancellations & No‑Shows

Booking Deposit: To secure an appointment, a non‑refundable deposit may be required and will be applied to the service balance if you attend as scheduled.

Cancellation/Reschedule Window: We require at least 24 hours’ notice to cancel or reschedule most appointments (48 hours for packages of 2+ hours or multiple services).

Late Cancellations & No‑Shows: Late cancellations or no‑shows may result in forfeiting the deposit and/or a cancellation fee up to 100% of the scheduled service value.

Late Arrival: If you are 10+ minutes late, we may shorten or reschedule your appointment and may charge a fee at our discretion.

Clinic Cancellations: If we must cancel or reschedule, your deposit will transfer to a new time, or you may request a deposit credit.
5) Pricing, Payments & Gratuities

Prices: Prices are subject to change without notice. Quoted prices at consultation are valid for the period stated at booking.

Payment Methods: We accept the payment methods posted at the time of service (e.g., major credit/debit cards, HSA/FSA where eligible, and cash). A valid card on file may be required to book.

Payment Timing: All balances are due at the time services are rendered. Some treatments or packages may require prepayment.

Gratuities: Gratuities are appreciated for spa/esthetic services where customary but are not required.
6) Refunds, Returns & Credits

Services: Because results are subjective and time‑based, all service sales are final and non‑refundable once rendered.

Prepaid Packages/Memberships: Unused portions of prepaid services may be credited to your client account, subject to any promotional adjustments or used‑service value. Credits are non‑transferable and expire 12 months from the date of purchase unless otherwise stated.

Retail Products: Unopened products in original packaging may be returned within 14 days with receipt. Opened or used products are not returnable unless defective as determined by the manufacturer.

Adverse Events: If you experience an adverse event, contact us immediately. A clinical evaluation will be performed; remediation may include follow‑up care rather than a refund.
7) Packages, Courses & Memberships

Benefits, pricing, and terms of packages/memberships will be described at purchase and may include usage windows, blackout dates, and auto‑renewal.

Unless stated otherwise in writing, packages and memberships are non‑refundable, non‑shareable, and non‑transferable.

To avoid renewal of an auto‑renew membership, submit written cancellation at least 7 days before the billing date.
8) Gift Cards & Promotions

Gift Cards: Redeemable for services or retail at Beauty by Us Miami. Not redeemable for cash, except where required by law. Lost or stolen cards will not be replaced.

Promotions: Discounts, trials, and special offers cannot be combined and may be subject to eligibility, time limits, and inventory. We may modify or end promotions at any time.
9) Health Information & Privacy

We collect and maintain personal and health information for treatment, operations, and payment. We protect this information using reasonable administrative, physical, and technical safeguards.

Additional privacy practices are described in our Privacy Notice, available in‑clinic and on our website. Where applicable, we comply with state and federal privacy requirements for health information.
10) Communications & Messaging Consent

By providing your phone number or email, you consent to receive service‑related communications (e.g., appointment confirmations, reminders, follow‑ups) and, with your opt‑in consent, marketing messages.

Message & data rates may apply. You may opt out of marketing emails by using the unsubscribe link, and opt out of marketing texts by replying STOP. You will continue to receive transactional messages necessary to your services.
11) Website & Online Booking

Account Security: You are responsible for maintaining the confidentiality of any login credentials and for all activity under your account.

Acceptable Use: Do not misuse our website, interfere with security features, or use automated scraping except as permitted by law.

Third‑Party Links: We are not responsible for third‑party sites or services linked from our website.
12) Intellectual Property

All trademarks, logos, photos, videos, content, and materials on our sites and in our clinic are our property or used with permission. You may not reproduce, distribute, or create derivative works without our written consent.
13) Contraindications, Aftercare & Follow‑Up

You agree to disclose conditions that may affect treatment safety (e.g., pregnancy, breastfeeding, autoimmune disease, recent procedures, active infections, keloid history, photosensitizing medications, isotretinoin within 6–12 months, etc.).

You agree to adhere to pre‑/post‑care guidance, including sun avoidance, product restrictions (e.g., retinoids, AHAs/BHAs), and follow‑up visits as directed.
14) Waiver, Release & Limitation of Liability

To the fullest extent permitted by law, you agree that Beauty by Us Miami, its owners, medical director(s), employees, and contractors are not liable for any indirect, incidental, special, or consequential damages arising from or related to the services.

Our total liability for any claim arising from the services is limited to the amount you paid for the service giving rise to the claim.

Some jurisdictions do not allow certain limitations; if so, those limitations apply to the maximum extent permitted.
15) Indemnification
You agree to defend, indemnify, and hold harmless Beauty by Us Miami and our personnel from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, misuse of services, or failure to follow pre‑/post‑care instructions.
16) Rescheduling for Safety & Medical Director Oversight
We may reschedule or cancel treatments to ensure client safety or to address clinical issues. Certain services may require approval or oversight by our supervising medical professional(s) as required by Florida law and applicable regulations.
17) ADA & Accessibility
We strive to provide an accessible experience. If you require a reasonable accommodation, please contact us before your visit so we can assist.
18) COVID‑19 & Communicable Illness Policy
If you are ill, have a fever, or have been recently exposed to a communicable disease, please contact us to reschedule. We may require rescheduling for the safety of clients and staff.
19) Dispute Resolution, Governing Law & Venue

Good‑Faith Resolution: Please contact us first to resolve any concern.

Governing Law: These Terms are governed by the laws of the State of Florida without regard to conflict‑of‑law principles.

Venue: Exclusive venue for any dispute shall be in the state or federal courts located in Miami‑Dade County, Florida.

Jury Trial Waiver: To the extent permitted by law, the parties waive the right to a jury trial.

Class Action Waiver: Disputes will be resolved on an individual basis; class or representative actions are not permitted.
20) Changes to Terms
We may update these Terms at any time. The “Last updated” date reflects the latest revision. Continued use of our services after changes become effective constitutes acceptance of the updated Terms.
Acknowledgment
By booking, purchasing, or receiving services from Beauty by Us Miami, you acknowledge that you have read, understood, and agree to these Terms, and that you have had the opportunity to ask questions before proceeding.
